Solicitor seeks to challenge law firm on alleged ageism
A partner in a law firm ,Leslie Seldon, is taking on his former firm which he claims forced him to retire at 65.
The case heard at the Employment Appeal Tribunal comes in the same month the Heyday case backed by Age Concern was heard at the European Court Of Justice. This case is testing the government’s interpretative legislation based on the EU’s equal treatment directive which imposed a mandatory retirement age for employers.
Mr Seldon lost the first round of the battle at the employment tribunal which found on the facts the partnership had justifiable grounds for having a set retirement age.
Having worked 35 years for the same business Mr Seldon wished to continue but effectively was barred for so applying. This appeal tribunal case follows hard on the heels of Peter Bloxham who sued the City law firm Freshfields for age discrimination relating to changes to the firm’s pension scheme which adversely affected him. The tribunal ruled in the favour of his employers last October.
