Boycott Wal-Mart website allowed


 

WIPO has allowed a S Korean owned website www.boycottwalmart.com by rejecting an attempt by the world’s largest retailer to gain control.  

 

The WIPO panel found it was unlikely that the site confused visitors into believing it was an official Wal-Mart site.  

 

Wal-Mart had argued the site was “confusingly similar” to its own registered domain addresses and marks but the panel ruled that nobody looking at the boycott site would imagine the site belonged to the retailer.  

 

The sole WIPO panellist however other cases could be argued on their own merits so this case does not hold precedence and other cases on different facts could be decided differently.
